Nova Body Clinic – TERMS AND CONDITIONS

Introduction: These Terms and Conditions ("Agreement") govern your use of services, memberships, and facilities at Nova Body Clinic ("the Clinic," "we," "us," "our"). By booking, purchasing, or using our services, you ("Client," "Member," "you") agree to be bound by this Agreement.


1. MEMBERSHIPS, PACKAGES & GIFT VOUCHERS


Membership Term & Renewal: We ask that all memberships are initially for a fixed term of six (6) months. Upon completion of this initial term, the membership will automatically continue on a month-to-month basis until it is paused or cancelled in accordance with these terms.


Cancellation of Membership: To cancel your month-to-month membership, you must provide thirty (30) days' written notice via email to novabodyclinic@gmail.com. Cancellation requests cannot be actioned via social media or verbally to staff. The membership fee for this final 30-day period is payable in full. Fixed-term (6-month) memberships are binding for the full term and cannot be cancelled early except under specific circumstances as required by Australian Consumer Law.


Fair Use Policy (Unlimited Memberships): "Unlimited" memberships are granted under a strict Fair Use Policy. This is defined as one (1) booked session per day, per member. The member who holds the membership must personally attend each session. This policy is in place to ensure equitable access for all members and the smooth operation of our schedule. Systematic booking of multiple sessions in a single day, or any activity that prevents reasonable access for other members, constitutes a breach of this policy. We reserve the right to review usage and, after providing a warning, may suspend booking privileges or terminate the membership without refund in cases of clear abuse.


Non-Transferable (Memberships Only): Memberships are personal to the named member and may not be transferred, shared, or gifted. Sharing membership access will result in immediate termination without refund. Treatment packages are subject to their own transferability terms below.


Freeze Policy: Memberships may be frozen for medical reasons (with a doctor's certificate) or for a minimum period of 2 weeks for travel, with 7 days' written notice. A maximum freeze period of 2 months per year applies.


Pre-Purchased Packages

  1. Treatment packages (e.g., sauna packs, facial series) are valid for 12 months from the date of purchase.
  2. Packages are non-refundable for change of mind, as permitted under Australian Consumer Law.
  3. Packages are fully transferable, you may gift unused sessions to another person by contacting us.
  4. Unused sessions expire on the date printed on your package. We are unable to extend packages beyond the expiry date.
  5. Packages cannot be redeemed for cash or credit except as required under Australian Consumer Law (e.g., faulty service).


Gift Vouchers

  1. Gift vouchers are valid for 36 months (3 years) from the date of purchase. The expiry date is printed on the voucher.
  2. Vouchers are non-refundable for change of mind, as permitted under Australian Consumer Law.
  3. Vouchers are fully transferable. If you receive a voucher as a gift, you may use it yourself or nominate another person to use it by contacting us.
  4. The physical voucher or digital code must be presented at the time of booking and again at the appointment.
  5. Lost or stolen vouchers cannot be replaced. Please safeguard your voucher code.


2. BOOKINGS, CANCELLATIONS, NO-SHOW & DEPOSIT POLICY


Deposit Requirement: A non-refundable 50% booking fee ("Deposit") is required to secure all appointments. The Deposit is applied to the total service cost.


48-Hour Confirmation Email: We will send a booking confirmation email 48 hours prior to your scheduled appointment. This email contains a link to confirm, cancel, or reschedule.


Cancellation & Refund Window: You may cancel or reschedule your appointment up to 24 hours before your start time using the link in your confirmation email for automated cancellation. If you do so, your Deposit (if booked online using our Vagaro app) will be refunded automatically to your original payment method.

Alternatively: you can send us a text message >24 hours before your booked appointment on 0405812285. This is our only clinic number.


Late Cancellation (within 24 hours): Cancellations or rescheduling requests made less than 24 hours before your appointment will result in forfeiture of the full 50% Deposit. No refund or credit will be issued.


No-Show: If you do not attend your appointment and have not cancelled, the remaining 50% of the service fee will be charged to the credit card provided at booking. By booking, you authorise this charge.


Late Arrival: To respect the next client's booking, late arrival may result in a shortened treatment. The full service fee remains payable, and no refund or partial credit will be issued for the missed time. We are unable to extend appointments beyond the scheduled end time.


Gift Voucher Bookings: Gift vouchers may be used to pay the Deposit, subject to the voucher terms in Section 1.


SMS Reminder: As a courtesy, we send an SMS reminder 24 hours prior to your appointment. Please note that this is a complimentary service and may occasionally be delayed or undelivered. We recommend you save your appointment details independently.



3. CLIENT CONDUCT & CLINIC RULES


No Extra Persons: To ensure a tranquil, professional, and safe environment for all clients and practitioners, and to maintain privacy and hygiene standards, clients may not bring additional guests (including friends, family, or children) to their appointment unless they are a carer or guardian required for assistance. This policy applies to all treatment rooms, including waxing and beautician services.


Health & Medical Disclosure: You must complete a consultation form truthfully and disclose all medical conditions, medications, allergies, and pregnancy prior to any treatment. Some treatments may require a doctor's clearance. We reserve the right to refuse service if we deem a treatment unsafe for you.


Right to Refuse Service

We reserve the right to refuse service to anyone for reasons including, but not limited to:

  1. Aggressive or abusive behaviour
  2. Intoxication or influence of drugs (particularly in the thermal suite)
  3. Infectious illness (please cancel and reschedule as soon as possible)
  4. Failure to comply with clinic policies or hygiene standards


Age Restriction: Clients under the age of 18 require written consent from a parent or legal guardian, who must be present for the consultation and initial treatment.


Personal Belongings: The Clinic is not liable for loss or damage to any personal belongings you bring onto the premises.



4. LIABILITY, COMPLAINTS & GENERAL PROVISIONS


Australian Consumer Law: Our services come with guarantees under the Australian Consumer Law that cannot be excluded. Nothing in these terms is intended to limit or modify your statutory consumer rights. Our liability for any failure to meet a consumer guarantee is limited, at our option, to resupplying the service or paying the cost of resupply. This clause does not apply to major failures as defined by the Act.


Complaints Procedure: We are committed to client satisfaction. If you are unhappy with any aspect of our service, please contact us as soon as practicable. Written complaints can be submitted to the Clinic Manager at novabodyclinic@gmail.com. We will acknowledge receipt within 3–5 business days and investigate promptly. This timeframe does not limit your rights under Australian Consumer Law.


Privacy: We collect and handle your personal information in accordance with our Privacy Policy, available on our website, and in compliance with the Privacy Act 1988 (Cth).


Intellectual Property: All content on our website, marketing materials, and within the clinic is our property and may not be reproduced without written permission.


Force Majeure: We are not liable for failure to perform our obligations due to events beyond our reasonable control (e.g., natural disasters, pandemics, utility failures).


Changes to Terms: We reserve the right to update these Terms and Conditions, prices, and policies at any time. Notice will be provided on our website and in-clinic. Continued use of our services constitutes acceptance of the new terms.


Governing Law: This Agreement is governed by the laws of Queensland, Australia.



5. PRIOR BUSINESSES & THIRD-PARTY VOUCHERS


Total Beauty

Total Beauty is a separate legal entity that previously operated at this address. They have ceased trading and are no longer affiliated with this location Shop 4/62 Hospital Rd. Emerald QLD 4720.


Nova Body Clinic is a new, independent tenant with no ownership, operational, or financial connection to Total Beauty. We did not purchase their business, or liabilities.


We do not accept gift vouchers, credits, or deposits issued by Total Beauty. Any amounts owed by Total Beauty remain the responsibility of that business.


Highlands Remedial

We proudly honour all valid gift vouchers purchased under our previous business name, Highlands Remedial.

  1. Valid Highlands Remedial Vouchers marked "FLOAT" may be used at Escape Float Therapy, 41 Ruby Street. We will arrange reimbursement directly with Escape Float Therapy on your behalf.
  2. Alternatively, we are happy to convert the dollar value of any valid Highlands Remedial voucher into clinic credit.

By proceeding with a booking, purchase, or membership, you acknowledge that you have read, understood, and agree to be bound by these Nova Body Clinic Terms and Conditions.
